r <br />PAGE 1 <br />AGREEMENT <br />AGREEMENT made and entered into this 29~` day of ?"~~-~ 19$O by <br />and between the CITY OF PLEASANTON, a municipal corporation (hereinafter <br />..referred to as "City") and JOHN CAROLINE and. JOAN CAROLINE, as joint tenants, <br />and KENNETH O. GOOCH and JUDITH GOOCH, as husband and wife., (hereinafter. <br />referred to as "Developer"). <br />WHEREAS, Developer is the owner of a parcel of property fronting on <br />Happy Valley Road, within the City of Pleasanton, more particularly described on <br />Exhibit "A" attac'ned hereto. and incorporated herein by reference; and <br />W'riEREAS, Developer has requested and City has approved a minor <br />subdivision number MS-79-7 subject to numerous conditions compliance with some <br />of which requires the agreement. herein prior to issuance of a building permit;. <br />and <br />WHEREAS, this agreement is intended to complywith conditions of <br />approval numbers 5, 6, 9, 10 and 11 of approval of minor subdivision MS-79-7. <br />NOW, THEREFORE, IT IS MtTTUALLY AGREED BETWEEN THE PARTIES HERETO AS <br />FOLLOWS: <br />1. Developer shall dedicate or cause to be dedicated within fifteen <br />(15) days after having received written notice therefor from the City Engineer <br />of City, to the City of Pleasanton that portion of the property described in <br />Exhibit "A" hereto determined by the City Engineer to be necessary for the <br />widening of Happy Valley Road. <br />2. That Developer shall construct or finance construction within the <br />right of Nray described in paragraph 1 above public improvements to the extent <br />required by the City of Pleasanton subdivision ordinance including but not <br />
