A G R E E M E N T <br />THIS AGREEMENT is made and entered into this ~~ day of <br />April, 1984, by and between THE PRUDENTIAL INSURANCE COMPANY <br />OF AMERICA, a New Jersey corporation (hereinafter referred <br />to as "Prudential"), and the CITY OF PLEASANTON, a municipal <br />corporation (hereinafter referred to as "City"). <br />RECITALS <br />A. There is significant proposed and approved industrial/com- <br />mercial growth in North Pleasanton. In order for such <br />growth to have adequate water, there must be improvements to <br />the City's water system, including the addition of an eight <br />million gallon reservoir in the vicinity of Foothill Road <br />("Foothill Reservoir"). <br />B. The parties contemplate that Foothill Reservoir, <br />the proposed Tassajara Reservoir and related water system <br />improvements will be included in an assessment district <br />("North Pleasanton Water Improvement District"). <br />C. Prudential is the owner of lands within the area <br />to be served by the proposed Foothill Reservoir. Prudential <br />has volunteered to provide funding in advance of the formation <br />of the North Pleasanton Water Improvement District to accelerate <br />the construction of the Foothill Reservoir, necessary engineering <br />for Foothill Reservoir, Foothill Road Improvements and <br />telemetry and control facilities in order that development <br />of its propcsed project can proceed expeditiously subject to <br />-1- <br />3' <br />~`~` <br />,_ _~ <br />
