~/ SEWER FAChLI~TIES Ar1D PRE=ANNEXATI"ON AGREEP~IENT THIS AGP~EMENT made and entered at Pleasanton, California this July 23, 1980 , by and between: THE CITY OF PLEASANTON, a general law City, with offices at 200 Bernal Avenue, Pleasanton, Alameda County, California, hereinafter referred to as "City," and EDWARD P. SHANNON AND WILMA H. SHANNON, - hereinafter referred. to as "Owner," subject to the following. terms and. conditions: W I T N E S S E T H: 1. RECITAL. Owner controls land within the General Plan area of City and desires to bring these lands within the jurisdiction of City. The land of Owner is not contiguous to the boundaries of City, thus requiring annexation of intervening land, together with that of Owner in order to avoid creation of an island o` .incorporated territory. The owners of intervening land are note sufficiently willing to annex to City at this time. Therefore, annexation of the land of Owner to Pleasanton is not at present `feasible. 2. CONSIDERATIODI. The City agrees to consider future annexations to the City of Pleasanton, and Owner agrees to co- operate fully in such annexation of that land controlled by Owner lying within Pleasanton Township, Alameda County, California. Owner and Cit agree that the provisions of this contract, the State laws, a d City ordinances and. resolutions shall control the. -responsibilit es of both parties. ' 3. LArd AREAS. The land affected bythis agreement shall be designated as follows: (a) Land of Owner more particularly described in the legal. description and map attached hereto as Exhibit A and made a part hereof... (b) The Land described in Exhibit A is developed with one residential structure. This agreement is limited to one (l) dwelling unit only.
