MODIFICATION OF AGREEMENT <br />THIS MODIFICATION AGREEMENT made and entered into <br />this ~ ~` day of ~ ~ 1974, by and between THE <br />CITY OF PLEASANTON, a municipal corporation, hereinafter <br />referred to as "City," and THE MORRIS STULSAFT TESTAMENTARY <br />TRUST, successor in interest to Land Development and Invest- <br />ment Company under that certain Annexation Agreement, dated <br />May 6, 1963, hereinafter referred to as 'OOwner." <br />W I T N E S S E T H- <br />WHEREAS, Owner's predecessor and City entered into <br />an Annexation Agreement dated May 6, 1963, with ,respect to" <br />certain described land within the City; and <br />WHEREAS, said Agreement provided, among other <br />things, that with respect to the provision within the area <br />covered by the Agreement, on neighborhood parks, Owner would <br />grant to the City the right to purchase, on stated terms and <br />conditions, a parcel of land to be used for neighborhood <br />park purposes, said parcel being described in Exhibit "A," <br />attached hereto and made a part hereof as though fully set <br />forth herein. <br />NOW, THEREFORE, it is agreed as follows: <br />1. The provisions of Paragraph 4(b) of that cer- <br />tain Annexation Agreement, dated May 6, 1963, is deleted and <br />the following paragraphs substituted in its place and stead: <br />(a) Neighborhood Park: <br />Owner hereby agrees to dedicate to <br />the City within thirty (30) days hereof, the <br />1. <br />
