3. NATURE OF USE. LICENSEE shall use the licensed area only on Wednesdays, Thursdays, Fridays and Saturdays, between the hours of 3 p.m. and 10 p.m., for the parking of motor vehicles for its employees, patrons and guests. LICENSEE may use cones to delineate the licensed area but shall remove the cones each evening and shall not use cones or block off other portions of the Exhibit A real property. LICENSEE may use the licensed area for parking purposes on days and times other than as described in the first sentence of this section but on a non exclusive basis, i.e., the licensed area shall not be coned or otherwise blocked off. LICENSEE may also use any other portion of the Exhibit A real property for parking purposes (a) on the days and times as described in the first sentence of this section if there is no more space available in the licensed area and if there is space elsewhere on the Exhibit A real property or (b) on days and times other than as described in the first sentence but on a non exclusive basis; provided, however, that in either event, LICENSEE shall not use cones or block off such portions of the Exhibit A real property. 4. CONDITIONS. This license is conferred on the following conditions: a) This License Agreement does not grant any interest in the Exhibit A real property to LICENSEE and LICENSEE's use is temporary, nonassignable and nontransferable. b) LICENSEE shall not commit or permit the commission of any kind of nuisance on or to the Exhibit A real property and shall comply with all rules, regulations and management policies now or hereafter established by the COUNTY. c) COUNTY's agents or employees may enter the licensed area when necessary to conduct COUNTY'S operations, to inspect, conduct lawful business and assure compliance with paragraph 1 1 herein below. d) The failure of LICENSEE to pay punctually any charges hereunder, when due, for at least 30 days, or any breach of any other condition of this License Agreement, shall at the option of COUNTY terminate the privileges of the LICENSEE and thereupon, COUNTY, its representatives, employees or agents shall have the right, without further demand or notice, to enter or take exclusive possession of the licensed area. LICENSEE hereby waives all notice and demand for possession and agrees that COUNTY may immediately enter and remove LICENSEE and property without legal notice or the institution of any legal proceedings whatever. e) LICENSEE shall place no permanent structure on the licensed area. 0 Upon termination of this Agreement, LICENSEE shall restore, at its own expense, the licensed area to a condition equivalent to that at the commencement of this license. 2
