District shall, without prior <br /> authorization of City, expend all funds necessary or appropriate <br /> for additions to, or expansions of, the Regional Sewerage <br /> Facilities, the facilities of TWA, LAVWMA, or such other Joint <br /> Use Facility as to which the parties may agree, or any component <br /> thereof which increases the Treatment Capacity Rights or Disposal <br /> Capacity Rights of either the parties; provided, that only <br /> revenues derived from the basic uniform regional connection fee <br /> or equivalent charge imposed pursuant to paragraph 10(a) shall be <br /> used for such purpose. <br /> (d) Capacity Acquisitions. Upon authorization by City, <br /> District shall acquire for City and, at its own discretion, <br /> District may acquire for itself, Disposal Capacity Rights or <br /> Treatment Capacity Rights, as the case may be, which are offered, <br /> or made available by or for TWA, LAVWMA, or with respect to any <br /> other Joint Use Facility which provides such Rights pertaining to <br /> facilities of, or made available through, those entities. Such <br /> acquisitions shall be made only with revenues derived from the <br /> basic uniform regional connection fee or equivalent charge <br /> imposed pursuant to paragraph 10(a). <br /> (e) Acknowledgement. The parties acknowledge that, prior <br /> to the date hereof, District has expended funds derived from the <br /> basic uniform regional connection fee or equivalent charge <br /> described in paragraph 10(a) for and on behalf of City to pay <br /> City's then current obligations to TWA and LAVWMA.
