DES:dft 1 07/92R (001/54) <br /> li,, 29/92R <br /> (cc) TWA the Tri- Valley Wastewater Authority, a <br /> separate agency established by joint exercise of <br /> powers agreement entered into pursuant to the <br /> provisions of Government Code Section 6500 et <br /> seq., by and among the City of Livermore, County <br /> of Alameda, City and District. <br /> 2. TERM. The term of this agreement shall commence <br /> upon the date hereof and shall continue so long as the <br /> Regional Sewerage Facilities shall remain in service, or <br /> unless the parties provide otherwise pursuant to the <br /> provisions of paragraphs 17 or 18. <br /> 3. SEWERAGE SERVICE AREAS. District's and City's <br /> respective sewerage service areas for purposes of this agreement <br /> consist of the respective legal boundaries of District and City <br /> as they exist upon the date hereof or as they may be adjusted in <br /> the future, together with areas outside of each party's <br /> boundaries which are presently receiving, or in the future may <br /> receive, sewerage service from District or City. However, <br /> neither party shall provide sewerage service in any area within <br /> the other party's Sphere of Influence as said sphere is defined <br /> pursuant to Government code Section 56076 and determined by the <br /> local agency formation commission exercising jurisdiction over <br /> such area, except with the express written consent of the other <br /> party. <br /> The sewerage service areas of the parties as of the date <br /> hereof are shown, for convenience only, in Exhibit "A" attached <br /> hereto, and by this reference incorporated herein. <br /> 10 <br />
