Neither party shall unreasonably withhold agreement to an expansion
meeting the aforementioned criteria. In addition, District shall
cause the basic connection charge set forth in Section 14 to be estab-
lished and shall maintain said charge until a new sewage rate study
is undertaken and new rates have been recommended which are reasonably
necessary to meet the financing needs established by Section 14, in-
cluding a reasonable amount to allow for future plant expansion.
The expansion of plant capacity approved by the Regional Board
shall be funded initially from the uniform, basic connection fee levied
pursuant to Section 14 of this contract. If the amount of the basic
connection fee is insufficient to fund all of the costs for expanding
the plant's capacity, District shall immediately notify City in writing.
Within fourteen (14) days of the above notice, the parties shall meet
and within thirty (30) days, agree in writing to fund the additional,
unfunded capacity either jointly or individually. If the parties agree
to participate jointly in providing the required additional funding,
they shall share proportionately the capacity so funded, based upon
each party's contribution. If one party unilaterally provides the
monies to pay for the unfunded additional capacity, the other party
having elected not to participate, the capacity so funded shall be
reserved exclusively for the funding party; the other, non funding
party shall not be entitled to use any capacity funded by the other
party without the express written authority of the funding party. The
funding party shall be responsible for and the beneficiary of any
increases or decreases in operation and maintenance costs attributable
to the expansion.
-12-
