addition, District's Plant is subject to regulations by the RWQCB.
District is required to develop plans for the Regional Board's review
regarding future expansion when District's Plant reaches 75% of its
capacity prescribed by Regional Board standards (Section 2252, Title
23, Chapter 3, California Administrative Code). In recognition of
the foregoing facts and to insure fair and equitable consideration of
future capacity needs of the parties, the following shall govern future
capacity requirements.
Within ninety (90) days following District's Plant reaching
seventy -five per cent (75 of its capacity as prescribed in Regional
Board discharge requirements, District and City shall cause a future
sewage treatment needs assessment and study to be prepared and com-
pleted on a timely basis. Such study may be undertaken by District
and City or by a mutually agreed to consultant. The study shall in-
clude, but not be limited to, a consideration of the following:
Projected additional plant capacity to provide sewerage services to
District and /or City based upon the most recent planning projections
made by District and City for their respective jurisdictions; projected
costs for additional capacity; projected sewer connection fees nec-
essary to fund the expansion, as well as provide necessary funds for
additions and improvements to comply with Section 13. Upon completion
of the study, if any expansion is indicated for either District or
City or both, District and City shall first agree upon a reasonable,
viable and logical size of the additional increment of sewage treat-
ment capacity to be added based upon accepted wastewater engineering
practices and then District shall apply to the Regional Board for
permission to proceed to add said capacity to its plant.
-11-
