President's Executive Order 11063
By this order, the FHA and VA are prohibited from insuring loans where
the builder or lender refuse to make the loan available because of the
buyer's race, color, creed, or national origin. Enforcement is
administered through a complaint - investigation hearing procedure
initiated by filing with either the FHA or VA Administration.
California Unruh Civil Rights Act
The law makes it unlawful for any business establishment to
discriminate because of race, color, etc. It was originally enacted
in 1968, although its coverage and enforcement provisions have been
expanded. A business establishment includes real estate brokers and
salesmen, financial institutions and, by interpretation, owners and
operators of housing with three or more units. The remedy is a civil
action for the recovery of any actual damages, plus a minimum
additional amount of $250. In some cases, an injunction can also be
obtained, preventing the defendant from selling or renting units in an
unlawfully discriminatory manner. While the California Attorney
General has initiated some cases, it is usually necessary to engage a
private attorney.
Federal Civil Rights Act of 1968
This law became effective when it was signed on April 11, 1986. Its
coverage extended initially to Federally owned or assisted housing.
As of January 1, 1969, coverage includes all dwellings except
single - family residences sold or rented without the services of a
person in the business of selling or renting, and discriminatory
advertising. Several unlawful acts or discrimination are described.
Enforcement is either by filing a complaint with the Department of
Housing and Urban Development, or by filing a law suit•in Federal or
state court. HUD may refer the matter to the FEPC or it may proceed
itself, depending upon whether the California remedies are considered
substantially equivalent to the Federal. The Court may appoint an
attorney and the judgement may include attorney's fees and up to
$1,000 damages in addition to the actual damages.
