improvements on the Land which the Lessor is obligated to <br />maintain or operate; <br />(iv) to use reasonable care to prevent any tenant <br />from committing or maintaining any nuisance or unlawful conduct <br />on or about the Project or the Land; <br />(v) to use its best efforts to prevent any tenant <br />from violating any of the covenants and conditions of this Lease <br />with respect to the Project or the Land; and <br />(vi) to take any action, if necessary, to abate <br />any violation of this Lease by any tenant. <br />6. Rights of Lessee and Distribution to Lessee. <br />(a) Subject to the terms and conditions set forth in <br />Section 5 above, the Lessee shall have the sole and exclusive <br />right: <br />tenant; <br />(i) to select and terminate the occupancy of a <br />(ii) to determine the eligibility of a tenant for <br />continued occupancy in the Project; <br />(iii) to give notice to a tenant to vacate the <br />Project or any part thereof, and <br />(iv) to institute and prosecute legal proceedings <br />against a tenant, and levy execution upon any judgment obtained <br />in such proceedings. <br />(b) Notwithstanding Lessee's commitment to operate and <br />maintain the Project predominately for Elderly Lower Income <br />Households and Elderly Very Low Income Households as set forth in <br />C:GDLEASE.EHI -15- <br />
