• 9 .10.82 E?- 138831 <br /> C169-018 <br /> O <br /> 15 . 1.1 Maintenance of Common Area. <br /> (a) The Association shall maintain, <br /> repair, replace, restore, operate and manage all <br /> of the Common Area subject to the provisions of <br /> Section 15. 1.1(b) . <br /> (b) The Association shall not be respon- <br /> sible for maintenance and repair of the Common <br /> Area arising out of or caused by the willfull or <br /> negligent act or neglect of an Owner, or his <br /> guests, tenants or invitees. The repair or <br /> replacement of any portion of the Common Area <br /> resulting from such excluded items shall be the <br /> responsibility of the Owner whose act or neglect, <br /> or whose guests, tenants, or invitees, by act or <br /> neglect, occasioned such repair or replacement. <br /> If an Owner shall fail to ' Make the repairs or <br /> replacements which are the responsibility of such <br /> Owner, as provided above, then, the Association <br /> may make such repairs or replacements, provided <br /> that the Owner thereof is given notice at least <br /> fifteen (15 ) days prior .to the Association' s <br /> proposed repair or replacement and the reasons <br /> therefor, and the opportunity to be heard by the <br /> Association, either orally or in writing, not less <br /> than five ( 5 ) days before the Association' s pro- <br /> posed repair or replacement, before a decision to <br /> L. so repair or replace is made.
