• 9. 10. 82 <br /> C169-018 6(` ! 3&31 <br /> gd <br /> request that it be done within a reasonable time, but no <br /> more than sixty (60 ) days from the giving of such notice. <br /> If the Owner fails to carry out such maintenance or repair <br /> within that period, or, if the Owner has failed to commence <br /> and diligently pursue the required work within that period <br /> where the work cannot be carried out within that <br /> period, the <br /> Association shall have the right, but not the obligation, to <br /> perform or cause such work to be done at the Owner's <br /> expense. If the Association elects not to perform or cause <br /> to be performed such work, any Person with the right to <br /> enforce this Declaration may, subject to the provisions of <br /> Section 8 .4, bring an action at law or equity to enforce the <br /> provisions of Section 5 . 1 . The costs incurred thereby by <br /> Declarant, the Association, an Owner or the City of <br /> Pleasanton, including attorneys ' fees and costs, shall be an <br /> Enforcement Expense as provided in Section 8.1 . <br /> 5.3 Right to Enter. The Association or its <br /> agents, and only the Association or its agents may enter <br /> upon any Lot when necessary in connection with the perfor- <br /> mance of the maintenance or repair work on said Lot pursuant <br /> to Section 5.2 . <br /> ARTICLE VI <br /> DEFAULT IN PAYMENT OF LIENS <br /> 6. 1 Obligation to Pay Liens .
