Declarant expressly reserves for itself, and the Association, if any; and their successors and assigns, together -With the right to grant and transfer the same, nonexclusive easements over and under the Lots for the installation, repair, and maintenance of elec- tric, telephone, water, gas, and sanitary sewer lines and facilities; drainage facilities, and landscaping as may be required herein or needed to service the Property. 7 .4 General . Each of the easements provided for in this Declaration shall be deemed to be established upon the recordation of this Declaration, and shall thenceforth be deemed to be covenants running with the land for the use and benefit of the Lots, the Owners thereof, the Association or Declarant, as set forth herein, superior to all other encumbrances applied against or in favor of any portion of the Property. Notwithstanding anything herein expressly or impliedly to the contrary, this Declaration shall be subject to all easements heretofore or hereafter granted by Declarant or the Association or their successors or assigns for the installation, repair and maintenance of public services and 'utilities that are necessary for the develop- ment and operation of the Property, including without limita- tion, sanitary sewer, water and drainage systems . -37-
