• <br /> 9. 10.82 <br /> • <br /> C169-018 ' EC— i 3663 <br /> maximum rate permitted by law, and the Association may, <br /> l._ at its option, bring an action at law or equity against <br /> the Owner personally obligated to pay same, or in <br /> compliance with the notice provisions set forth herein, <br /> to foreclose the Enforcement Lien against the Lot, <br /> either by power of sale or by an action at law. There <br /> shall be added to the amount of such Enforcement. Ex- <br /> pense, the late charge, and all costs of foreclosing <br /> the Enforcement Lien, including interest and attorneys ' <br /> fees and costs. Declarant and each Owner vests in the <br /> Association, its successors and assigns, the right and <br /> power to exercise the power of sale or to bring all <br /> actions at law or equity or lien foreclosure against <br /> such Owner for the collection of such delinquent <br /> Enforcement Expenses. <br /> (b) No action shall be brought to foreclose <br /> an Enforcement Lien or to roceed on the <br /> p power of sale <br /> herein provided less than thirty (30) days_ after the <br /> date a notice of claim of lien is deposited in the <br /> United States mail , certified or registered mail, <br /> postage prepaid, to the Owner of said Lot, and a copy <br /> thereof is recorded by the Association in the Office of <br /> the County Recorder of Alameda County; said notice of <br /> claim must recite a good and sufficient legal descrip- <br /> tion of the affected Lot, the record Owner or reputed <br /> Owner thereof, the amount claimed (which may, at the <br /> Association's option, include interest on the unpaid <br /> -41- <br />
