• 9. 10. 82 , , C169-018 Ec` ! 388 3 • sixty-five percent (65%) of the total area of all the Lots in the Park; provided, however, that so long as at least twenty percent (20%) of the Property is owned by Valley Business Associates no such termination, extension, modi- fication or amendment shall be effective without the written approval of Valley Business Associates. No such termina- tion, extension, modification or amendment shall be effec- tive until a proper instrument in writing has been executed and acknowledged, and recorded in the office of the Recorder of Alameda County, California. ARTICLE XI DECLARANT' S RIGHTS AND DUTIES Any and all of the rights, powers and reservations of Declarant or of Valley Business Associates herein con- tained may be assigned to any person, corporation or associa- tion which will assume the duties of Declarant or Valley Business Associates, as the case may be, pertaining to the particular rights, powers and reservations assigned, and upon any such person, corporation or association' s evidenc- ing its consent in writing to accept such assignment and assume such duties , he or it shall, to the extent of such assignment, have the same rights and powers and be subject to the same obligations and duties as are given to and assumed by Declarant or Valley Business Associates , as the case may be , herein. The term "Declarant" as used herein includes all such assignees and their heirs , successors and -47-
