K. If the City requests the Developer to provide
sewers of greater capacity than required by City standards and
the Developer pays more than its pro-rata share of the cost of
constructing such sewers, the Developer may enter into a
reimbursement agreement with the City or request the City to
create a benefit district so that owners of other properties
benefitted by such facilities reimburse the Developer for the
amount the Developer pays in excess of its share. The Developer
shall reimburse the City for the cost of creating such benefit
district.
L. If either the City or the Developer desires a
recycled water line between the Ruby Hill Project and the City' s
designated connection point, the cost of constructing said line
and the price to be paid for said water will be subject to a
separate contract between the City and Developer.
M. The City shall enter into an appropriate agreement
with the City of Pleasanton regarding the ownership of the sewer
system facilities and the administration of the sewer service,
including but not limited to: imposition of connection and
periodic sewer service fees, administration of the billings for
services rendered, the maintenance of equipment, and service to
the ultimate consumer.
EXX-EC11)/1iv11.dk 5.
