This Agreement obligates the City to provide sewer <br /> service (i) . only to that geographical area subject to the County <br /> of Alameda' s Zoning Conditions for the Ruby Hill Project, and <br /> (ii) only for the land uses and densities approved by such Zoning <br /> Conditions and those changes to. such Zoning Conditions which are <br /> non-material, or which are material and acceptable to the City <br /> pursuant to paragraph 8 . a. of the Settlement Agreement. Except <br /> as to the three acre commercial site provided for in the <br /> preannexation agreement for the Southern Topham Property, for <br /> which the City agrees to provide sewer service at Developer' s <br /> expense, this Agreement does not obligate the City to provide <br /> sewer service to the Property east of the proposed alignment of <br /> Isabel Avenue Extension. <br /> J. It is the responsibility of the Developer to <br /> construct all sewer laterals, lines and mains for the Ruby Hill <br /> Project in accordance with design guidelines and construction <br /> standards of the City existing when such facilities are <br /> constructed.
