SALARIES AND LIABILITIES
Each participating agency will incur its own salary, benefits, and insurance, as well as
safety equipment, weapons, vehicles, trailers and other necessary equipment.
Furthermore, each agency will bear all Workers' Compensation responsibility for its
respective employees assigned to the regional team. Each agency shall defend,
indemnify, save and hold harmless each other agency, its officers, agents, and
employees from any claims, suits or actions of every name, kind and description
brought forth, or on account of, injuries to or death of any person, including but not
limited to, workers and the public, or damage to property, resulting from or arising out of
indemnitor agency's performance of obligations or exercise of rights created by this
memorandum of understanding, except those matters arising from indemnitee agency's
negligence.
This agreement is between the law enforcement agencies and is not intended to be a
joint powers agreement under Section 6500 of the Government Code of the State of
California. Personnel assigned to the regional team shall be deemed continuing under
the employment of their jurisdiction and shall have the same powers, duties, privileges,
responsibilities, and immunities as are conferred upon him/her as a peace officer in
his/her own jurisdiction.
FINANCING
Each agency will bear overtime expenses incurred for training and tactical activations.
Each agency will provide their participating personnel with the requisite safety
equipment which is set forth in the policy and procedures of the East County Tactical
Team SWAT Manual. Replacement costs of expendable items used during training or
call-outs will be shared on an equitable basis. A detailed accounting of such items will
be maintained by each Team Leader (SWAT TL - Sniper/Observer TL — CNT TL) and a
written statement of costs incurred will be submitted semi-annually for payment.
EQUIPMENT PURCHASES
At the time of any approved joint purchase, each department shall pay an equal share.
The Tactical Commander will keep an inventory of items obtained in this manner.
In the event one City withdraws from the MOU, the following options may be exercised;
a. The remaining City shall have the right of first refusal to purchase
the pro-rated share from the seceding City;
b. If the remaining City does not wish to purchase the pro-rated share
from the seceding City, then the seceding City shall have one year
to purchase the equipment from the remaining City;
c. If neither the remaining City nor the seceding City wishes to
purchase any joint equipment, then the remaining City shall be
granted ownership of the equipment.
6
