M E M O R A N D U M
DATE: March 22, 1991
TO: Pleasanton Management Staff
FROM: City Manager
SUBJECT: Clarification Management Vacation and Sick Leave
As you know, management positions within the City have been
designated as exempt positions under the Federal Fair Labor
Standards Act. What this means is the Act's overtime provisions
requiring overtime payments to persons who work in excess of a
certain number of hours in a defined work period don't apply to
your position.
A recent Federal Appellate Court decision stated that if an exempt
employee, in the absence of accrued sick leave or vacation leave,
had his pay docked for a sick leave or a vacation leave absence of
less than a regular work day, the employee would not be entitled to
the exemption. Although this situation has never occurred in
Pleasanton, if a manager had no accrued sick leave or vacation
leave and was absent for less than his /her regular work day, the
City would continue the manager's full salary and charge the used
hours to the appropriate leave account in the form of a negative
balance.
Because of this recent court case, it is important that our policy
on this issue precisely reflect our practice. We have, therefore,
revised those sections of our management compensation plan that
address this issue.
The revised wording is attached for your information. If you have
any questions please consult Larry Miller.
