Report No. 54 Zone 7 Water Contract Negotiations
Mr. Fales summarized the City Manager's Report No. 54 which related the background of
the negotiations with Zone 7 and indicated a long list of questions that should be
considered by the City Council before entering into the final contract. He went on
to say that while no specific recommendations regarding the Zone 7 proposal were
contained in the report, he indicated that it was worthly of further serious consider-
ation, and that further research should be accomplished in order to answer specific
questions.
Mr. Fales concluded by suggesting that a study session be scheduled for September
13, 1965 with Zone 7 staff personnel who had volunteered to be present in order to
answer questions.
Review of Subdivision Agreement; Maintenance Bond Mission Park
Mr. Fales read a memorandum which related the background of some confusion which had
arisen between the property owners and the City with regard to the Subdivision
agreement and the maintenance bond provisions pertaining to Mission Park. He went
on to summarize the agreement and the bond provisions for the benefit of the affected
property owners and the City Council.
Among other things the documents provided for the binding one year maintenance dead-
line on the lots of units 2, 3, and 4 of Mission Park. With regard to public im-
provements within the subdivision and the obligations for report, these documents
indicated that if they were not made the City could proceed against the bonding co.
Mr. Struthers advised the Council that the City should proceed against the bonding
company 15days before the expiration of the Maintenance period, and in view of this
the Council instructed the staff to report back prior to November 10, 1965.
Progress Report Sewage Treatment Plant; Standard Cheese Co.
Mr. Fales read a report from the Director of Finance which outlined the status of
the Standard Cheese Co. sewage discharge problem. This report indicated that as of
this date the staff felt that the Cheese Company had cooperated with the City in
eliminating a difficult problem, and has made substantial progress in the general
upgrading of their operation.
Mr. Campbell elaborated upon the report and stated that the only thing to be done
at this time would be to wait and see how the system works, and that the staff would
continue to review the situation and make reports as long as necessary.
George Spiliotopoulos, representing the Cheese Factory, addressed the City Council
and expressed appreciation for the efforts and consideration of the City, and indicat-
ed that he would continue to cooperate with the City in any way possible.
Adams Way Footpath; Valley View School
Mr. Fales reviewed the problem of providing a walkway by which the childred attending
Valley View School could walk from Pleasanton Heights to the school. He also related
the background of attempting to provide a connecting street from Adams Court to
Mirador Drive. He indicated that since the City has been unable to negotiate success-
fully with the property owners to provide the connecting street, the temporary walk-
way was the only practical solution at this time.
Mr. Fales went on to say that because of the possible liability involved, he would
recommend that the City initiate condemnation proceedings on the applicable properties
for an easement for a walkway and a water line.
After some discussion, it was moved by Councilman Cairo and seconded by Councilman
McWilliams that the City Attorney be authorized to initiate condemnation proceedings
for an easement on the applicable properties for a walkway and a water line.
The roll call vote was as follows:
AYES: Councilman Cairo, Harding, McWilliams and Mayor Long
NOES: None
ABSENT: Councilman Bubics
Annexation Services Agreement; Schulte Blackwell
Mr. Fales stated that because of the recent reversal by the Court of Appeals, V.C.S.D.
apparently did not desire to enter into a sanitary sewer agreement with the City
regarding the Schulte Blackwell area. Instead, V.C.S.D. wanted to enter into an
agreement directly with Schulte Blackwell which would provide for sewer service to thq
property and provide for annexation to V.C.S.D. if the property is not annexed to
Pleasanton.
9 -7 -65
