10. <br /> <br />records of County Library patrons will be referred to the County, and that <br />the County will refer any requests for access to the registration and <br />circulation records of Pleasanton Library patrons to the City. <br /> <br />Location of Security System: The City will not physically relocate any part of <br />its 3-M security system without securing in advance the written approval of <br />the County in order to assure that the security system will not interfere with <br />the operation of the III system. The County will not withhold its approval <br />unreasonably. <br /> <br />Payments: The City of Pleasanton agrees to pay the County of Alameda <br />$108,709 in four (4) quarterly installments as follows: <br /> <br />September 30, 2000- $27,177.25 <br />December 31, 2000 - $27,177.25 <br />March 31, 2001 - $27,177.25 <br />June 30, 2001 - $27,177.25 <br /> <br />11. <br /> <br />12. <br /> <br />Extension/Cancellation: All terms and conditions of this contract may be <br />extended, by mutual agreement, on a year-to-year basis, provided the City <br />Council desires to continue funding library automation services for the <br />Pleasanton Library through this contract and that the County determines that <br />providing these services is not detrimental to its own operations. If either <br />party does not intend to renew for the following fiscal year, that party shall <br />give written notice to the other party no later than January 1 of each year. <br /> <br />Liability: <br /> <br />All persons employed in the performance of such services and <br />functions for the City shall be County employees or contractors, <br />including any temporary help hired by the County through a <br />temporary employment agency, and no person employed in such <br />services shall be considered an employee of the City for any <br />purpose. No person hereunder shall have any City pension, Civil <br />Service, or other status or right. <br /> <br />The City shall not be called upon to assume any liability for the direct <br />payment of any salary, wages or other compensation to any County <br />employees or contractors performing services hereunder for the City, <br />or any liability other than that provided for in this agreement. <br /> <br />-7- <br /> <br /> <br />
