unless such encumbrances and conditions are specifically approved <br />and accepted by ZONE 7. <br /> <br /> 2. Improvements to said facilities shall be performed in <br />accordance with said plans and specifications, and with any <br />modifications thereto approved by the General Manager of Zone 7. <br /> <br /> 3. The total amount of funding participation available from <br />ZONE 7 for improvement of the aforesaid flood control facilities <br />shall not exceed the sum of $230,000.00 for LINE B-2-3 and shall <br />not exceed the sum of $125,000.00 for LINE B-2-4. <br /> 4. CITY shall bill ZONE 7 for improvements of the flood <br />control facilities based on the progress payments to the <br />contractor, but not in excess of the amount'available under <br />Paragraph 3 hereof. <br /> <br /> 5. CITY shall pay all construction cost in excess of the <br />amount stated in Paragraph 3. <br /> <br /> 6. ZONE 7 shall be responsible for inspection of LINE <br /> B-2-3. CITY shall give ZONE 7 at least two (2) days advance <br /> notice before commencing any work on LINE B-2-3 described herein <br /> so that adequate provision for field inspections by ZONE 7 can be <br /> made. All work shall be performed to the satisfaction of the <br /> General Manager of ZONE 7. <br /> <br /> 7. Upon completion and acceptance of the work by both <br /> parties as called for herein and acceptance by ZONE 7 of any <br /> rights-of-way required for said work, the ownership and <br /> maintenance of LINE B-2-3 shall rest with ZONE 7. <br /> <br /> 8. The ownership and maintenance of LINE B-2-4 shall rest <br /> with CITY. Any additional improvements needed within the <br /> watershed to LINE B-2-4 shall be the responsibility of the CITY. <br /> <br />- 2 - <br /> <br /> <br />
