The
plans for the work will show conditions as they are supposed or
believed by the engineer to exist, but the conditions shown on the
plans do not constitute a representation by the public agency that
those conditions actually exist; neither the public agency nor its
officers or representatives shall be liable for any loss sustained by
the contractor as a result of a variance between condition's'~hown on
the plans and the actual conditions at the site.
Pole lines, power lines, pipe lines, buildings, structures, railroads,
or other public or private improvements may be within the limits of
the work or adjacent thereto; these may or may not be shown on the
plans.
It will be assumed that the bidder has investigated and is satisfied
with the conditions to be encountered, the character, quality and
quantities of work to be performed and materials to be furnished, and
the requirements of these plans and specifications and the contract.
Submission of a proposal shall be considered conclusive evidence that
the bidder has made such examination.

CDS.i.6

21
