City agrees <br />to initiate a rezoning proposal to a zoning district compatible <br />with the proposed use upon request of Zone 7. In addition, <br /> <br />City is favorably disposed to allocate the appropriate <br /> <br />sewer connection to Zone 7 for the proposed development. <br />Finally, Zone 7 agrees to submit design plans for the proposed <br />project to City for review pursuant to the City's design <br />review ordinance. Zone 7 will comply with all reasonable <br />requests of the City relating to aesthetics of the project. <br /> <br /> 5. Costs and Attorneys Fees. <br /> <br /> The prevailing party in any action to enforce or construe <br /> <br />the terms of this Agreement mav recover from the other party <br />its reasonable costs and attorney's fees expended in connection <br />with such an action. <br /> <br />-3- <br /> <br /> <br />
