Definitions <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 12 June 7, 2022March 8, 2018 <br />Agency, pursuant to the Federal Resource Conservation and Recovery Act (42 USC Section 6901, 362 <br />et seq.), all future amendments thereto and all rules and regulations promulgated thereunder. 363 <br />1.68 “Holidays” means New Year’s Day, and Christmas Day for the purposes of planning the Collection 364 <br />schedule. 365 <br />1.69 "Household Hazardous Waste" means Hazardous Waste generated at Residential Premises 366 <br />within the City. 367 <br />1.70 "Infectious Waste" means medical or biomedical waste generated at hospitals, public or private 368 <br />medical clinics, dental offices, research laboratories, pharmaceutical industries, blood banks, 369 <br />mortuaries, veterinary facilities, and other similar establishments that are identified in Health 370 <br />and Safety Code Section 25117.5. 371 <br />1.71 "Litter" means any quantity of Solid Waste, Recyclable Materials, or Organic Materials, which is 372 <br />not placed in a Container. 373 <br />1.72 “Liquidated Damages” means the amounts owed by Contractor to City for failure to meet 374 <br />specific quantifiable standards of performance as described in Section 11.6 and Exhibit E. 375 <br />1.73 “Mulch” means a layer of material applied on top of soil, and, for the purposes of the 376 <br />Agreement, Mulch shall conform with the following conditions, or conditions as otherwise 377 <br />specified in 14 CCR Section 18993.1(f)(4): 378 <br />A. Meets or exceeds the physical contamination, maximum metal concentration, and pathogen 379 <br />density standards for land applications specified in 14 CCR Section 17852(a)(24.5)(A)(1) 380 <br />through (3). 381 <br />B. Was produced at one or more of the following types of Facilities: 382 <br />1. A Compostable material handling operation or facility as defined in 14 CCR Section 383 <br />17852(a)(12), that is permitted or authorized under Division 7 of Title 14 of the CCR, 384 <br />other than a chipping and grinding operation or facility as defined in 14 CCR Section 385 <br />17852(a)(10); 386 <br />2. A Transfer/Processing Facility or Transfer/Processing operation as defined in 14 CCR 387 <br />Section 17402(a)(30) and (31), respectively, that is permitted or authorized under 14 388 <br />CCR, Division 7, Chapter 12; or, 389 <br />3. A Solid Waste landfill as defined in PRC Section 40195.1 that is permitted under 27 CCR, 390 <br />Division 2. 391
