(Document No. 2018-007097) that
memorialized the earlier City Council resolutions, mandated funding for a public restroom
within Valley Trails Park, extended the duration of the City approval, and memorialized fees to
be imposed on the development.

On April 17, 2018, the City Council approved the final map, improvement plans, and a
Subdivision Agreement for Tract 8259 (Book 353 of Maps at Pages 59-64) with Ponderosa
Homes II, Inc. The agreement was executed on the same day.

On December 19, 2018, the subdivider recorded a Declaration of Covenants, Conditions, and
Restrictions of Sycamore that created a homeowner’s association (Document No. 2018-
239647).

On June 22, 2020, Ponderosa Homes II, Inc., entered into a Stormwater Treatment Measures
Inspection and Maintenance Agreement (Document No. 2021-321070) that memorialized the
subdivider’s obligations with respect to stormwater management.

On August 4, 2020, the City Council authorized a First Amendment to Subdivision
Improvement Agreement that reimbursed the subdivider for additional costs associated with a
water main replacement on Valley Trails Drive. The reimbursement allowed street resurfacing
and sidewalk/curb ramp upgrades on Valley Trails Drive within the vicinity of the water main
replacement. The additional cost of $293,595 was allocated from the Streets CIP General
Fund account.

On July 1, 2021, a Second Amendment to the Subdivision Improvement Agreement was
executed that extended the duration of the original agreement by four additional years.

On January 24, 2023, a Third Amendment to Subdivision Improvement Agreement was
executed that extended the duration of Section 10 “Defects” of the original agreement due to
discovered failures in the roadway including cracks and subsidence. The Third Amendment
also required the subdivider to reimburse the City for costs associated with evaluating the
roadway cracks and subsidence. As a result of this discovery, the subdivider voluntarily
repaved the public roads within the subdivision at no cost to the City. Although the Third
Amendment required the Defects provision to be extended from one year to three years, staff
is now recommending the provision be extended for two years because the roads were
repaved.
