• Retains the original term of the agreement through August 5, 2034
• More clearly defines responsibilities and field access
• Removes the $200 per year fee paid by the City to PUSD for weed abatement
• Removes the entire section related to the Multipurpose Facility
• Provides a statement of cooperation for the upcoming construction of the Educational
Option Center at the current Village High School site
• Provides that once the agreement expires, PUSD will take sole ownership of all City-
installed infrastructure.

Fairlands Park/ Fairlands Elementary School Fencing
In 2018, the City and PUSD entered into an agreement for the fencing between Fairlands Park
and Fairlands Elementary School. However, this fence currently splits a contiguous grass field
with PUSD maintaining both the PUSD section and the City section while irrigation is currently
tied to PUSD’s system for both parcels. The proposed agreement:
• Provides a 10-year term
• Allows PUSD to expand the fence line to incorporate the City’s parcel (Attachment 4,
Exhibit B)
• Outlines PUSD’s obligations for fence work and construction
• Outlines PUSD’s responsibility for installation, maintenance, and repair of fencing and
property within fencing
• Outlines City’s responsibilities for maintenance
• Requires public access to the City parcel when school is not in session.

City and PUSD staff recommend terminating the following agreements:
• Tennis Courts Community Recreation (Attachment 5)
• Synthetic Fields Use Agreement (Attachment 6).

Tennis Courts Community Recreation
The Tennis Courts Community Recreation agreement was entered into on August 5, 1968,
with a 66-year term. This agreement was for tennis courts at Pleasanton Elementary School;
staff believe this was extended by oral agreement to the tennis courts at Pleasanton Middle
School. Staff from both agencies recommend returning maintenance and scheduling of these
courts to PUSD. The City does not currently program or rent these courts; however, they are
available for drop-in play after school hours and on the weekends. PUSD would continue to
make the courts available for community use.

Synthetic Fields Use Agreement
The Synthetic Fields Use Agreement was executed while PUSD was renovating its high school
fields and expires on July 30, 2024. This agreement covers the synthetic fields at Amador
Valley High School, Foothill High School, and Bernal Community Park. While it served a
purpose, staff from both agencies now recommend that the use of synthetic fields revert to the
standard rental protocols for each agency, by requesting and paying for use through the
existing scheduling systems.
