However, after discussions among staff and <br />a legal review by the city attorney, it was determined these would be better managed through <br />the regular rental/use processes for each agency or by developing a new agreement for a <br />specific facility, if necessary. <br /> <br />DISCUSSION <br />City and PUSD staff recommend no changes to the following agreements: <br />• Walnut Grove Elementary and Harvest Park Middle Schools Fencing <br />• Mohr Elementary School Fencing. <br /> <br />City and PUSD staff recommend the City Council adopt new or updated agreements for the <br />following: <br />• Amador Valley High School Tennis Courts (Attachment 1) - UPDATED <br />• Amaral Park (Attachment 2) - NEW <br />• Pleasanton Upper Bernal Field Use (Attachment 3) - UPDATED <br />• Fairlands Park/Fairlands Elementary School Fencing (Attachment 4) – UPDATED. <br /> <br />Amador Valley High School Tennis Courts <br />The existing Amador Valley High School Tennis Courts agreement had a term of July 10, 2021 <br />to December 21, 2023. As this agreement has expired, the updated agreement: <br />• Provides a five-year term <br />• Clearly identifies dates and times for City use <br />• Defines City and PUSD cleaning and maintenance responsibilities <br />• Includes a $2,000 annual contribution by the City for court maintenance. <br /> <br />Amaral Park <br />The existing fencing agreement at Mohr Elementary School does not clearly define park <br />maintenance responsibilities. As such, a new agreement for Amaral Park is recommended. <br />This proposed agreement: <br />• Provides a five-year term <br />• Defines the park as a joint-use facility allowing for PUSD use during periods when <br />school is in session <br />• Clearly outlines the City’s responsibility for maintenance and communication of a <br />maintenance schedule to the district <br />• Defines how the City will comply with the Healthy School Act <br />• Requires the school district to provide summer school dates by May 1 of each year. <br /> <br />Pleasanton Upper Bernal Field Use <br />The Upper Bernal Field Use agreement is proposed to be updated as follows: <br />Page 43 of 228
