City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

119
West Environmental Services and Technology, Inc. prepared a Closure
Evaluation for the proposed project site on October 9, 2023 (Appendix F). The
Closure Evaluation determined that the chemicals present at the project site
do not pose an unacceptable threat to human health based on a residential
land use exposure scenario and that no further actions to address conditions
were required. Therefore, the RWQCB concluded that the project site can
remain a closed site and no further action or evaluation is required.19 Based
on this evaluation, no Phase I ESA would be required for the proposed project
pursuant to Housing Element Update FEIR MM HAZ-2.
As discussed in the Housing Element Update FEIR, to prevent and minimize
hazardous conditions to below a level of significance, existing local, State,
and federal law would be enforced. Compliance with existing regulations
would ensure that construction workers and the public are not exposed to
any risks related to hazardous materials during demolition and construction.
The proposed project would comply with Cal/OSHA regulations concerning
the use of hazardous materials, including requirements for safety training,
exposure warnings, availability of safety equipment, and preparation of
emergency action/prevention plans. All contaminated waste would be
collected and disposed of at an appropriately licensed disposal or treatment
facility.
Environmental effects would be avoided by the imposition of uniformly
applied development policies or standards. As such, there are no
environmental effects that are peculiar to the proposed project. The
proposed project would not result in a new or more severe adverse impact
that was not previously identified in the Housing Element Update FEIR.
c) Hazardous Emissions Proximate to a School
Would the project: Emit hazardous emissions or handle hazardous or acutely
hazardous materials, substances, or waste within one-quarter mile
of an existing or proposed school?
Summary of Housing Element Update FEIR
The Housing Element Update FEIR indicated that there are schools within 0.25
mile of the rezoned housing sites. However, use of hazardous materials during
construction and operation of the sites would not result in the handling of
significant quantities of hazardous materials, substances, or wastes, and such

19 McCaulou, Cherie.
