City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

121
and/or remediation work would be required to ensure that construction
activities would not expose people or the environment to adverse effects, as
required by MM HAZ-2. Therefore, with implementation of MM HAZ-2 and
compliance with applicable federal, State, and local laws, as well as
compliance with appliable plans and regulations, as enumerated in more
detail in Section 3.8, Hazards and Hazardous Materials, in the Housing
Element Update Draft EIR, impacts related to the creation of a hazard to the
public or environment would be less than significant.
Proposed Project Analysis and Conclusion
The project site was identified as needing further evaluation regarding
previously detected VOCs and organochlorine pesticides in soil and
groundwater by the Housing Element Update FEIR. The RWQCB closed the
project site in 2003 based on the available data.
Additional sampling was conducted in 2007 by Cornerstone to evaluate the
data with respect to current California State Water Resources Control Board
(State Water Board) Environmental Screening Levels (ESLs).
West Environmental Services and Technology, Inc. prepared a Closure
Evaluation for the proposed project site on October 9, 2023 (Appendix F). The
Closure Evaluation determined that the chemicals present at the project site
do not pose an unacceptable threat to human health based on a residential
land use exposure scenario and that no further actions to address conditions
were required. Therefore, the RWQCB concluded that the project site can
remain a closed site and no further action or evaluation is required.20 Based
on this evaluation, no Phase I ESA would be required for the proposed project
pursuant to Housing Element Update FEIR MM HAZ-2.
Furthermore, the proposed project would comply with applicable local,
State, and federal regulatory requirements related to the handling and
storage of hazardous materials. Therefore, there are no environmental effects
that are peculiar to the proposed project. The proposed project would not
result in a new or more severe adverse impact that was not previously
identified in the Housing Element Update FEIR.
e) Proximity to Public Airport Safety Hazard
Would the project: For a project located within an airport land use plan or, where such
a plan has not been adopted, within two miles of a public airport

20 McCaulou, Cherie.
