P24-0670, -0671, and -0672, 1803 Santa Rita Road Planning Commission
2 of 12
as KFC which formerly occupied the subject site within the past two years, previously
approved by the Planning Commission and have been or were operating without any reported
issues. Conditions of approval have been included which will ensure the safety and general
welfare of the surrounding area, and the City in general, is maintained.

BACKGROUND
PUD Development Plan and Uses
The subject site, located in Valley Plaza Shopping Center (VPSC), is zoned Planned Unit
Development – Commercial (PUD-C) District and is subject to the conditions of approval of
PUD-73-2 adopted by the City Council under Ordinance No. 719. Each building within VPSC is
subject to the uses of either the Office (O), Central-Commercial (C-C), Service-Commercial
(C-S), or Neighborhood-Commercial (C-N) Pleasanton Municipal Code (PMC) Zoning
District(s). The subject site follows the uses of the C-C District. No development or design
standards (i.e., building height, setbacks, floor area ratio, minimum parking ratio, color
schemes, finish materials, signage, etc.) were established with the PUD. Therefore, proposed
projects are subject to case-by-case review. The majority of VPSC is also zoned Housing
Opportunity Zone and is designated as a housing site in the 6th Cycle Housing Element
Update; however, that designation does not preclude the existing or future commercial uses
permitted by the existing PUD.

The PMC permits restaurants in the C-C District with any restaurant that includes a
drive-through being subject to a CUP. The subject building was constructed within the past five
years and was operated as KFC with a drive-through, pursuant to an existing CUP for the
subject site, until approximately two years ago. The drive-through lane was in operation for
approximately 30 years prior to KFC’s departure.

Conditional Use Permit
PMC Section 18.124.100.A. states the conditions under which a use permit will lapse and shall
become void. Based on these provisions, and since KFC vacated the site more than a year
ago, a new CUP is required for the proposed drive -through coffee restaurant.

The CUP, DR, and SDR applications are now before the Planning Commission for
consideration.

AREA AND SITE DESCRIPTIONS
Area Description
VPSC, shown in Figure 1, is located at the northwest intersection of Santa Rita Road and
Valley Avenue and consists of five multi-tenant and four single-tenant buildings that have
various uses (restaurants, convenience markets, beauty salons, offices, retail, etc.). VPSC is
bordered on the north by Mission Plaza Shopping Center; east, across Santa Rita Road, by a
City park (Orloff Park) and Danbury Park Townhomes; on the south, across Valley Avenue, by
the Chevron Gas Station, Hallmark store, and Avana Apartment Homes; and on the west by
Valley Plaza Apartment Homes.
