The application was then recommended to the City Council for approval.

On August 18, 2020, the City Council approved a Negative Declaration in conformance with
CEQA (Resolution No. 201179), PUD-135 (Resolution No. 201180), Growth Management
Agreement (Resolution No. 201181), and Vesting Tentative Map 8352 through adoption of
Ordinance No. 2210.

DISCUSSION
Approval of a final map, when the map substantially complies with the conditions of the vesting
tentative map, is a ministerial act by the City Council according to California Government Code
Section 66474.1. The final map for Tract 8528 grants to the City the public service easements
across the property frontages for the benefit of utility purveyors. The map also grants a public
trail easement across the west and south sides of the property in conformance with the
adopted Trails Master Plan (Appendix A, Figure A-5), and a storm drain easement across a
portion of Sycamore Creek.

The subdivider has executed a subdivision agreement and provided surety bonds in
conformance with California Government Code Section 66499 to guarantee the construction of
improvements required by PUD-135. Submitted surety bonds ensure both the subdivider’s
performance and the subdivider’s payment for labor and materials. The agreement also
requires the subdivider to warranty the improvements for one year after completion.

The subdivider has also executed a Trail Maintenance Agreement and a Creek Maintenance
Agreement that transfer maintenance obligations for the public trail and Sycamore Creek
segment to the owners of the lots where these features reside. The agreements indemnify the
City from claims. Should the lot owners fail to maintain the facilities, the City is granted a right
to perform the maintenance at the expense of the owner(s).

Staff reviewed the final map, improvement plans, subdivision agreement, Trail Maintenance
Agreement, and Creek Maintenance Agreement and found the documents to be in substantial
conformance with the requirements of PUD-135 and, therefore, recommends approval of these
documents.

EQUITY AND SUSTAINABILITY
Not applicable, as this item is an administrative matter of City business.

OUTREACH
PUD-135 and Ordinance No. 2210 were subject to public hearings at the Planning
Commission and City Council. Condition of Approval 36 requires the subdivider to notify
neighbors within 300 feet of the project site prior to construction.

STRATEGIC PLAN ALIGNMENT
Approval of this action advances the ONE Pleasanton strategic plan goal of Building a
Community Where Everyone Belongs.

FISCAL IMPACT
The proposed subdivision will have a negligible financial impact on the City.
