November 8, 2024
Page 28

7357-013acp
printed on recycled paper
Code, the County must request that the water district prepare a WSA for the
projects and include it for public comment in the Draft EIR.

There is also evidence in the record that the existing water supply from the
local water district may not be adequate to serve the Arroyo Lago Project, let alone
the Senior East County Lakes Project. In 2022, the California Water Service
Company Livermore District (“Cal Water”) provided the County with a will-serve
letter for the Arroyo Lago Project based on the Project’s plan to drill wells on site
and equip them with necessary water storage and booster pumps.140 However, Cal
Water retracted the will-serve letter in October 2023, explaining:

Cal Water has not evaluated the forecasted water system needs of this
development, the ability of Zone 7 to serve this new development under the
existing Cal Water contract, nor conducted a review of the water system
evaluation of this new development. As such, all claims in the documentation
regarding the availability of water for the development have not been
validated by Cal Water, the future water purveyor for this development.141

The Cal Water letter stated that, as of October 2023, Cal Water was working
with USL Pleasanton Lakes, L.P. to develop a Letter of Agreement (“LOA”) to
provide water service to the Arroyo Lago Project, but that the LOA was still under
negotiation.142 The addition of the 569-unit Senior East County Lakes Project will
substantially expand the water supply needs at the Project site, and may require
significant changes to the LOA Cal Water is considering. The Projects’ cumulative
water supply needs must be quantified and discussed in the WSA and EIR.

2. Hazardous Materials / Soil Contamination

A portion of the Project site was formerly an aggregate mining facility and is
undergoing ongoing regulatory cleanup for hazardous substances under the
supervision of the Alameda County Department of Environmental Health
(“ACDEH”).143 The current site status is listed as “OPEN - LONG TERM
MANAGEMENT AS OF 7/18/2017.”144 In October 2022, ACDEH responded to the
Arroyo Lago Project application by explaining that site closure would be dependent

140 Exhibit E – Letter from California Water Service to Alameda County re Will Serve
Tract or Parcel Map No: PM 11230 Owner: USL Pleasanton Lakes, L.P.
