City of Pleasanton—Villages at the Quarry Project
Consistency Checklist 15183 Consistency Checklist

86
resident or migratory fish or wildlife species or with established native resident
or migratory wildlife corridors.4 However, existing stored equipment and
structures on-site may serve as a potential nesting location for birds.
Potential direct and indirect impacts could occur to resident and migratory
species during project construction, which would render the project
temporarily unsuitable for birds because of the noise, vibrations, and
increased activity levels associated with various construction activities. These
activities could potentially subject birds to risk of death or injury, and they
would likely avoid using the area until such construction activities have
dissipated or ceased. Relocation, in turn, could cause hunger or stress
among individual birds by displacing them into adjacent territories belonging
to other individuals.
Existing resident bird species, including killdeer, were observed on-site during
the April 2024 survey. These species are known to nest in disturbed, gravelly
areas. If project-related activities take place during the nesting season
(February through August), pre-construction surveys would be required prior
to grading and/or vegetation removal. If any bird listed under the MBTA or
nursery site is found within or adjacent to the project site, an adequate buffer
zone would be established to avoid potential impacts. Approval of the
proposed project would be conditioned upon compliance with
recommendations provided in the project-specific BRA (MM BIO-1). This
includes avoidance and minimization measures to riparian habitat.
Implementation of these conditions, including general avoidance and
minimization measures, would ensure that any potential biological resource
impacts remain less than significant as described in the Housing Element
Update FEIR. Therefore, the proposed project would not result in any
significant environmental effects that are peculiar to the proposed project.
The proposed project would not result in a new or more severe adverse
impact that was not previously identified in the Housing Element Update FEIR.
e) Local Biological Resources Policies/Ordinances Consistency
Would the project: Conflict with any local policies or ordinances protecting biological
resources, such as a tree preservation policy or ordinance?
Summary of Housing Element Update FEIR
The Housing Element Update FEIR indicated that Heritage Trees are located
throughout the Planning Area and could be within the rezoned housing sites.

4 California Department of Fish and Wildlife (CDFW). 2024.
