Accordingly, for purposes of the 310 single-family detached
market-rate units in Villages 1, 2, and 3, the 20 percent requirement triggers an obligation to
provide a total of 62 inclusionary affordable units.

The requirements of the IZO are complemented by standards of the ODS with respect to
specific required affordability levels and bedroom mix. A minimum of 25 percent of the
inclusionary units are to be restricted at 50% of the Area Median Income (AMI) (Very Low-
Income Units), 25 percent of the units at 60% AMI (Low-Income Units), and 50 percent of the
units at 80% AMI (Low-Income Units). With respect to bedroom mix, 10 percent of total
inclusionary units will be three-bedroom units, 45 percent of the units will be two-bedroom
units, and the remaining units will be studio or one-bedroom units except no more than 10
percent of the units may be studios. The applicable zoning district (HOZ District) also includes
other standards with respect to affordable housing, including location and design, generally
mirroring the ODS. While the IZO generally requires the affordable units to be distributed
among the market-rate units, a key provision of the HOZ is to permit clustering of the
affordable units, where the inclusionary units are permitted to be in a rental apartment building
or complex concentrated in an area of the project.

However, the IZO also includes provisions for alternative compliance in Section 17.44.080, as
follows: “The primary emphasis of this inclusionary zoning ordinance is to achieve the inclusion
of affordable housing units to be constructed in conjunction with market rate units within the
same project in all new residential projects. However, the city acknowledges that it may not
always be practical to require that every project satisfy its affordable housing requirement
through the construction of affordable units within the project itself. Therefore, the
requirements of this chapter may be satisfied by various methods other than the construction
Page 119 of 682
