2
1.Density for New Residential and Commercial Office Development
The TOC Policy established minimum density and intensity requirements for any TOC
areas where eligibility for grant funding may be sought.1 The City is not required to change
the zoning of properties within the TOC areas for specific land use or density. Still, the
properties would need to meet the zoning density and intensity requirements identified in
the TOC Policy if the existing zoning allows new residential, office, or mixed-use
development.
The density requirements vary based on “tiers;” as noted, the two BART stations are
considered “Tier 3” and the ACE station is considered “Tier 4.”2
Minimum and maximum densities are summarized in Table 1 below.
Table 1: TOC Policy Density Requirements
TOC
Area
Residential
Average
Minimum
Density
Residential
Average
Maximum
Density
Commercial
Office
Average
Minimum
FAR
Commercial
Office
Average
Maximum
FAR
Two
BART
Stations
(Tier 3)
50 units/net
acre or
higher
75 units/net
acre or
higher
2 or higher 4 or higher
ACE
Train
Station
(Tier 4)
25 units/net
acre or
higher
35 units/net
acre or
higher
1 or higher 3 or higher
In general, the residential densities are in line with those that have already been adopted
for housing sites on and around the Dublin/Pleasanton BART Station; for example, the
BART station itself is designated at 75 units to the acre; the nearby Oracle site at 50-75
units to the acre.
With respect to Downtown, current residential densities are varied and, in some instances,
fall below the minimums and maximums (e.g., RM-4,000 District), whereas in others (C-C
District), they come close to the TOC Standards and/or FARs. It is unlikely that full
compliance with the Tier 3 Standards will be sought as a priority.
2.Affordable Housing Production, Preservation, and Protection Policies and
Commercial Stabilization Policies
The TOC policy requires the City to adopt at least two policies from a menu of options in
each of the affordable housing “production,” “preservation,” and “protection” categories, in
1 If maximum density requirements are also adopted by the City, they must support robust transit-oriented
development; height maximums are not specified in the TOC policy but must not limit building heights to preclude
the development prescribed in the TOC Policy.
2 The minimum density/intensity in a given zoning district where housing and/or commercial office uses are
permitted may be below the TOC Policy thresholds as long as the average across the TOC area meets the
requirement.
