approval. This approval found that the Program Environmental Impact Report (EIR) for the
City’s Sixth-Cycle Housing Element Update satisfied the requirements of the California
Environmental Quality Act (CEQA).

COMMISSION ACTION
On November 8, 2023, the Planning Commission adopted Resolution PC-2023-15 approving
Vesting Tentative Map 8676 pursuant to the application filed as P23-0605 for the Harmony
project. The vesting tentative map creates a one-lot condominium parcel with overlying public
service (PSE), emergency vehicle access (EVAE), and public access (PAE) easements. The
PSE and EVAE extend across the private loop road, while the PAE extends along Santa Rita
Road and Lockhart Lane.

DISCUSSION
The on-site water, sanitary sewer, and storm drainage networks, as well as the loop road and
common area, will be privately owned and managed by a homeowners association. A widened
public sidewalk along Santa Rita Road and a new sidewalk along the north side of Lockhart
Lane will accommodate pedestrian access needs. The loop road will accommodate emergency
vehicle access and provide space for utilities (electricity, gas, and telecommunication
services).

Approval of the final map and acceptance of public easements (PSE, EVAE, and PAE) for
Tract 8676, when the map substantially complies with the conditions of the vesting tentative
map, is a ministerial act by the City Council according to California Government Code Section
66474.1. The subdivider has executed a Subdivision Improvement Agreement that guarantees
installation of city-required subdivision improvements.

The subdivider transferred their obligations under the Subdivision Improvement Agreement to
their contractor according to an Agreement for Completion of Improvements. The contractor
provided surety bonds in conformance with California Government Code Section 66499.
Submitted surety bonds assure the contractor’s performance and payment for labor and
materials. The agreement also requires the contractor to guarantee the completed
improvements for one year.

Staff reviewed the final map, improvement plans, Subdivision Improvement Agreement, and
Agreement for Completion of Improvements, finding the documents to be in substantial
conformance with the requirements of the Zoning Administrator approval and Planning
Commission Resolution PC-2023-15. Staff, therefore, recommends approval of these
documents.

EQUITY AND SUSTAINABILITY
Not applicable, as this item is an administrative matter of City business.

OUTREACH
Condition of Approval 25 of the Zoning Administrator approval requires the subdivider to notify
neighbors within 300 feet of the project site of the construction schedule. Resolution PC-2023-
15 was subject to public hearings before the Planning Commission.
