(B) Claim Format. A Claim must be submitted in the following format: <br />(1) General introduction, specifically identifying the submission as a <br />"Claim" submitted under this Section 7. <br />(2) Relevant background information, including identification of the <br />specific demand at issue, and the date of City's rejection of that demand. <br />(3) Detailed explanation of the issue(s) in dispute. For multiple issues, <br />separately number and identify each issue and include the following for <br />each separate issue: <br />(a) The background of the issue, including references to relevant <br />provisions of the Contract Documents; <br />(b) A succinct statement of the matter in dispute, including <br />Contractor's position and the basis for that position; <br />(c) A chronology of relevant events; <br />(d) The identification and attachment of all supporting documents <br />(see subsection (A), above, on Substantiation); and <br />(e) Use of a separate page for each issue. <br />(4) Summary of issues and damages. <br />(5) The following certification, executed by the Contractor's authorized <br />representative: <br />"The undersigned Contractor certifies under penalty of perjury that its <br />statements and representations in this Claim are true and correct. <br />Contractor warrants that this Claim is comprehensive and complete as to <br />the matters in dispute, and agrees that any costs, expenses, or delay claim <br />not included herein are deemed waived. Contractor understands that <br />submission of a Claim which has no basis in fact or which Contractor <br />knows to be false may violate the False Claims Act (Government Code <br />Section 12650 et seq.)." <br />(C) Submission Deadlines. <br />(1) A Claim must be submitted within 15 days of the date that City <br />notified the Contractor in writing that a request for a change in the <br />Contract Time or Contract Price has been rejected in whole or in part. <br />(2) With the exception of any dispute regarding the amount of Final <br />Payment, any Claim must be filed on or before the date of Final Payment, <br />or will be deemed waived. <br />Annual Curb & Gutter for Street Resurfacing Project, CIP No.25509 Page 42 <br />
