The ordinance would generally require larger residential and commercial projects to
install public art, with an allowance for payment of a fee in lieu of providing the art. A separate
resolution (Exhibit B) would adopt the accompanying in-lieu fee as part of the Master Fee
Schedule.

Development Projects Subject to Public Art Contribution:(13.20.030.A)
The following classes of projects would be subject to the Public Art Contribution requirement:
• All new non-residential development, including expansions, equal to or greater than 5,000
sq. ft
• All new residential development projects in excess of 20 residential units, exclusive of
accessory dwelling units or junior accessory dwelling units
• Non-residential building alterations equal to or greater than 5,000 sq. ft.
• A project, other than a single-family home, or otherwise exempted project, involving the
alteration of an existing structure or structures where the value of the construction would
exceed $1,000,000.

Development Projects Not Subject to Public Art Contribution (13.20.030.B)
The following classes of projects would be exempt from the Public Art Contribution requirement,
generally small projects, and community-serving projects for which the additional burden of a
public art requirement is less appropriate:
• Single-family residences
• Projects with 20 or fewer residential units
• Tenant improvement projects
• Affordable housing projects
• Child Care Facilities as defined in PMC 17.38.020
• Buildings and facilities used exclusively by nonprofit agencies and institutions exempt
under Section 501(c)(3) of the Internal Revenue Code of 1986 to provide social services to
the general public
• Buildings and facilities used exclusively for religious purposes as defined in the California
Revenue and Taxation Code Section 207
• Underground public works projects
• Street or sidewalk repairs
• Tree planting or median landscaping
• Remodeling, repair, or reconstruction of a structure damaged by fire, flooding, wind,
Page 165 of 864
