However, the Windsor HOA subsequently entered
into an agreement with the City to assume responsibility for routine plant maintenance and
irrigation water costs, resulting in notable savings for the district.

Based on updated analysis completed over the past year, staff has determined that
assessments can be restored to the amounts originally approved at the time of formation for
all LMDs. As a result, staff now plans to resume Proposition 218-compliant processes for all
LMDs during the upcoming fiscal year, with property owner votes anticipated for the
Ponderosa, Bonde Ranch, and Windsor districts.

For the Moller Ranch (District 1995-1) and Oak Tree Farm (District 1994-1) districts, the
originally authorized assessment amounts are sufficient to address current and projected
maintenance and capital needs. These will be implemented in phases over time, including the
addition of an annual inflation escalator based on the Bay Area Consumer Price Index (CPI),
in accordance with the original formation documents.

The information provided in this report regarding staff’s intention to pursue increased
assessments is informational only and intended to support the proposed public hearing
scheduled for July 15, 2025.
