PLEASE READ IT CAREFULLY <br /> <br />SUTTON SPECIALTY INSURANCE COMPANY <br /> <br />COMMERCIAL GENERAL LIABILITY POLICY <br /> <br />EXCLUSION – POOL POP UP AND POOL OVERFLOW <br /> <br />The following exclusion is added to Section II, Common Policy Exclusions: <br /> <br />This insurance does not apply to: <br /> <br />“Bodily injury” or “property damage” arising out of, resulting from, caused by, contributed to by, or in any way related, in <br />whole or in part, to any actual or alleged “pool pop ups” or “pool overflows”. <br /> <br />For purposes of this endorsement, the following definitions shall apply: <br /> <br />1. “Pool pop ups” means any actual or alleged “bodily injury” or “property damage” caused by an <br />“occurrence” where a constructed or installed swimming pool rises up out of the ground, regardless <br />of the magnitude, scope, nature, cause or causes, of the movement. <br /> <br />2. “Pool overflows” means any water discharge or overflow from within any constructed or installed <br />swimming pool for any reason. <br /> <br />This exclusion shall apply whether or not any such “pool pop up” or “pool overflow” as so defined is alleged to be intentional, <br />willful, reckless, negligent, or on any other basis. <br /> <br />Except as set forth above, all of the terms, conditions and exclusions of this policy apply and remain in effect. <br /> <br />Policy No.: Sutton Specialty Insurance Company <br /> <br />Date: By: <br /> <br />Time: 12:01 a.m. _______________________ ___________________________ <br /> Lloyd Yavener, President Michelle Freitag, Secretary <br />07/18/2025 <br />ISCP04000060976 <br />Docusign Envelope ID: C32ED128-E8C0-4517-B42B-471D21968944
