Item #5
CITY COUNCIL AGENDA REPORT

November 4, 2025
Community and Economic Development

TITLE: AUTHORIZE THE CITY MANAGER TO ENTER INTO A FOURTH AMENDMENT
TO THE PROFESSIONAL SERVICES AGREEMENT WITH MARK THOMAS &
COMPANY, INC., FOR AN ADDITIONAL $999,954, FOR A NEW TOTAL
CONTRACT AMOUNT OF $3,995,644, TO COMPLETE 100 PERCENT DESIGN
FOR PHASE 2 OF THE WEST LAS POSITAS MULTIMODAL RECONSTRUCTION
PROJECT (OWENS DRIVE TO SANTA RITA ROAD, CIP NO. 26514)

SUMMARY
On December 6, 2022, the City Council awarded an agreement to Mark Thomas & Company,
Inc. (Mark Thomas) to provide detailed design and construction documents for Phase 1 of the
West Las Positas Multimodal Reconstruction Project (from Hopyard Road to the Iron Horse
Trail). Phase 2 of the West Las Positas Multimodal Reconstruction Project extends the
improvements from the Iron Horse Trail/Owens Drive to Santa Rita Road. On August 19, 2025
the City Council authorized the City Manager to execute a project funding agreement with
Alameda County Transportation Commission (ACTC) to receive a $750,000 grant to complete
the design and construction documents for Phase 2 of the Project. Staff requests that the City
Council authorize an Amendment to the Professional Services Agreement with Mark Thomas
to complete this work. The grant award requires a 25 percent local match; the City’s Direct
Local Distribution of Measure BB Pedestrian and Bicycle Funds is proposed to be used to
provide the $250,000 match, covering the total $999,954 estimated cost of the amendment to
prepare the Phase 2 design and construction documents.

RECOMMENDATION
Authorize the City Manager to issue the Fourth Amendment to the Professional Services
Agreement with Mark Thomas & Company, Inc., for an additional $999,954, for a new total
contract amount of $3,995,644, to complete 100 percent design for Phase 2 of the West Las
Positas Multimodal Reconstruction Project (Owens Drive to Santa Rita Road, CIP No. 26514).

BACKGROUND
West Las Positas Boulevard is a key east-west arterial roadway and a critical connection for
the city’s bicycle, pedestrian, and transit networks, providing a primary link from residential
neighborhoods to regional trails, schools, retail, and office land uses. The portion of the road
between Hopyard Road and Stoneridge Drive was constructed in the early 1980s as part of the
development of the Hacienda Business Park. West Las Positas Boulevard has a history of soil
settlement and differential movement within the Hacienda Business Park, resulting in uneven
roadway surfaces and localized roadway failures.

In 2018, the City adopted an update to the Bicycle and Pedestrian Master Plan, which
identified the West Las Positas Boulevard corridor between Foothill Road and Fairlands Drive
as the highest priority for pedestrian and bicycle improvements.

Docusign Envelope ID: 13052E52-7AE9-4FA9-885F-4547DF464456
