The 6th Cycle Housing Element identifies the BART site for residential development, as did the
4th and 5th Cycle Housing Elements. Since adoption of the most recent Housing Element, the
site has been rezoned to the Housing Opportunity Zone (HOZ) and therefore, the BART site is
both assumed and designated to allow for housing at densities identified in the Housing
Element (i.e., 75 dwelling units per acre, minimum of 555 units). Since the 4th and 5th Housing
Element cycles, changes have occurred, including State law changes such as adoption of AB
2923, the Transit-Oriented Communities (TOC) Policy adopted by MTC-ABAG, and other site
conditions, particularly a significant decrease in BART rider parking demand post-pandemic as
travel patterns have changed.

Specifically, although the Housing Element conservatively assumed 555 units for the site, the
minimum allowable density of 75 dwelling units per acre prescribed by AB 2923 (BART transit-
oriented development) and the TOC (transit-oriented communities) Policy yields 1,118 units on
14.9 gross acres. AB 2923 also requires the City to allow a minimum of five stories and limit
parking to a maximum of one space per residential unit (whereas the City’s municipal code
requires parking based on the number of bedrooms). Further, SB 79, which was recently
signed into law and takes effect July 1, 2026, will require that up to nine stories be allowed on
sites at BART stations.

In addition to these statutory requirements, the site would also need to comply with the
standards and design parameters in the Hacienda Design Guidelines and the City’s adopted
Objective Design Standards, although in the event of a conflict, State law would prevail.

Scope of Work
The project scope of work includes:
• Project initiation – introductory meetings with the consultant team and key
stakeholders, evaluation of existing conditions and input by the community/Planning
Commission/City Council. A memorandum of understanding (MOU) with BART to
memorialize the collaborative and cooperative relationship of the project was also part
of this stage and was approved by the City Council on July 15, 2025.

• Market analysis – an analysis to evaluate potential future scenarios of non-residential
uses.

• Station Access and Parking Management – evaluation of station access and parking
demand to understand the need for and opportunities to accommodate BART rider
parking on the site and alternative parking strategies, as well as to accommodate
multimodal circulation. A preliminary review has been completed, but a more in-depth,
focused review and evaluation is anticipated to occur with a second set of project grants
the City has been awarded from MTC-ABAG, specific to both station access and
parking management.

• Re-use Options – draft re-use scenarios for the site identify conceptual blocks,
circulation framework, open space areas, BART station access, vehicular and bicycle
parking, and potential multi-modal transportation improvements. These scenarios are
before the City Council for review at this meeting for feedback.
