Recovered Organic Waste Product Enforceable Mechanism Language <br /> <br />The following language may be included in City contracts and agreements to ensure <br />compliance with the City’s Recovered Organic Waste Product procurement requirements <br />described in Section 5.4 above. <br /> <br />Section X, Adherence to City’s Green Purchasing Guidelines and SB 1383 Procurement <br />Requirements <br /> <br />1. Contractor shall ensure that all services provided to the City under this <br />Agreement, and all products the Contractor uses to service the City under this <br />Agreement, shall comply with all applicable requirements in Appendix A, <br />Green Purchasing Guidelines and SB 1383 Procurement Requirements, unless <br />otherwise approved by the City Representative. <br /> <br />2. Contractor will permit the City to audit, examine and make copies of all <br />contracts, invoices, and other documents or data relating to this Agreement. <br />Such records shall be maintained for (5) five years from the date of final <br />payment under this Agreement. <br /> <br />3. City may assess liquidated damages and/or terminate this Agreement at any <br />time if Contractor is found to be non-compliant with the applicable <br />requirements in Appendix A. <br />Page 163 of 373
