P25-0227, 1061 Serpentine Lane, Suite G Planning Commission
10 of 11
attendance, and drop-off nature of many participants makes actual on-site parking demand
substantially lower and manageable within the shared lot. The City’s Traffic Engineering
Division has reviewed the proposal, and believes adequate on-site parking exists to
accommodate all existing and the proposed uses and would not result in the exceedance of
the available shared on-site parking capacity.

However, should parking problems occur, staff has recommended a condition of approval that
allows the Director of Community Development to refer the CUP permit back to the Planning
Commission for possible additional mitigation measures. These could include reducing the
number of students on-site at any one time or establishing alternative operating hours.

Noise
As stated previously, proposed conditional uses must be in accord with the PMC's
objectives. One objective is to promote the stability of existing land uses that conform to the
General Plan and protect them from inharmonious influences and harmful intrusions.

Additionally, for industrial properties, such as the subject parcel, the PMC states, “No person
shall produce or allow to be produced by any machine, animal, device, or combination of the
same, a noise level in excess of 75 dBA [A-weighted decibels] at any point outside of the
property plane.”

Staff notes that the proposed use is unlikely to result in a substantial change in ambient noise
levels on sensitive receptors in the area due to the existing traffic and train noise generated in
the area by the nearby Valley Avenue, Stanley Boulevard, and Union Pacific Railroad tracks.
Moreover, all proposed activities would occur inside the subject building, and any noise
generated from these activities will be consistent with the activities and the associated noise
levels generated by the other surrounding commercial, office, education, religious, light
industrial, etc., within the Business Park.

To further minimize any noise impacts, staff is recommending the following conditions of
approval:

• All doors shall always remain closed during activities and/or business hours.
• The applicant shall inform their clients and employees not to loiter outside of the
building and to be courteous and quiet when entering or leaving the parking area .
• The City shall have the right to review the project again to add mitigating conditions
should any future complaints regarding noise levels occur. Such conditions could
include reducing the number of people allowed in the building at any one time,
modifying the hours of operation, and requiring additional soundproofing of the subject
building.

With the inclusion of the recommended conditions above , staff has determined it is unlikely the
noise produced by the proposed use would adversely affect adjacent tenant spaces or be
more than 75 dBA at any point outside of the property plane as prescribed by the PMC.
Therefore, staff does not believe the proposed use would be disruptive to existing or future
neighboring businesses/tenants or residences to the west. As stated above , other similar types
of educational-based uses have been operating within Valley Business Park for several years
with no issues reported to the City.
