Such access may only be permitted when authorized by the District, as set forth
below.

5. The PPD may utilize the District's Avigilon System by installing Avigilon software.
Access will be permitted by use of authorized accounts set up by the District, which will
be password protected. Unauthorized access (including access for purposes beyond that
described under paragraph 6 below) or unauthorized sharing of access to the District's Avigilon
System is prohibited and may result in the immediate termination of this MOU by the District.

6. Consistent with and for purposes of the agreed upon, authorized access described in
paragraph 4 above, the PPD may only access and utilize the District's Avigilon System
and the resulting videos, footage, or recordings as specified below:

A. If there is an imminent threat and/or emergency where Emergency Situation Access in
real time will assist with the protection of the health or safety of a District pupil, pupils,
staff, or other person or persons, whether at the request of the PPD or the District, the
PPD may access the live video feed remotely, at the PPD's Real Time Information Center,
or at a specified school site. If the request for access is initiated by the PPD, then within
72 hours of addressing the imminent threat and/or emergency, the PPD shall provide the
District with written documentation detailing the reason for access, including the
articulable facts establishing the imminent threat and/or emergency to the health or safety
of District pupils, staff, or others. This MOU does not grant the PPD access to prior
recordings, unless such footage is necessary to provide situational awareness related to
the imminent threat; only live video footage may be accessed under this provision.

B. In the event that live video footage and/or recording requests are made through a valid
warrant, subpoena, or California Public Records Act request, no information shall be
shared by the PPD without the express written consent of the District. The PPD must
notify the District within four (4) hours of receiving a subpoena, document demand, or
CPRA request, and immediately upon receipt of a warrant. Additionally, the PPD will
not seek a warrant for recordings or footage from the Avigilon System without
consulting with the District first.

C. Whenever the PPD is granted access to the District's Avigilon System for purposes
described in 6.A. or 6.B., if such access occurs remotely, the PPD monitor screens should
be positioned so as to avoid accidental or occasional viewing by non-PPD personnel who
may otherwise have cause to be in the vicinity.

7. Should it be necessary for the PPD to request to obtain a digital recording of any surveillance video
from the Avigilon System, the PPD shall contact the Deputy Superintendent or Superintendent
designee to make the request in writing. The PPD may not record, preserve, or publish any video or
other images from the Avigilon System using a separate device, such as by taking photos or video
footage on a smartphone except in the case where the capture of an image would assist responding
Docusign Envelope ID: 640A4474-1873-4B33-91F9-3008DF7C8D07
