Beginning on August 13, 2024, City staff initiated direct outreach to the eleven (11) parties
utilizing Santos Ranch Road. Outreach efforts included multiple mailed notices enclosing the
Proposed License Agreement, as well as follow-up phone calls and coordination with
responding parties. Staff continue to conduct direct outreach to secure executed agreements.

STRATEGIC PLAN ALIGNMENT
Not applicable, as this item is an administrative matter of City business.

FISCAL IMPACT
To date, the maintenance account for Santos Ranch Road has a remaining balance of
approximately $326,000.

Under the 1994 Agreement, parties were required to pay an annual maintenance fee ranging
from $150/year for parties with a residence accessed by Santos Ranch Road to $100/year for
parties with non-residential improvements accessed by Santos Ranch Road. Historically, these
fees were inconsistently collected and enforced, resulting in minimal impact on mitigating the
City’s costs when the City performed in accordance with the maintenance schedule of Santos
Ranch Road.

The Proposed Agreement eliminates the annual maintenance fee and does not obligate the
City to adhere to a defined maintenance schedule. Instead, the City may maintain Santos
Ranch Road on an as-needed basis to meet City operational requirements. As a result,
approval of the Proposed Agreement is anticipated to have minimal fiscal impact.

If the interested parties elect to maintain Santos Ranch Road to a higher standard than
required for City use, they would be required to enter into a separate agreement to fund such
improvements. The City would not be obligated to finance additional maintenance beyond what
is necessary for its operational needs.

Prepared by: Submitted by: Approved by:

Adam Nelkie, Assistant Dir.
of Public Works -
Engineering
Siew-Chin Yeong, Director of Public
Works

Gerry Beaudin, City
Manager

Attachments:
1. Proposed License Agreement (Form for Residential Owners)
2. Resolution for Agreement with East Bay Regional Park District
3. Resolution for Agreement with Geno Tolari
4. 1994 Maintenance Agreement (Historical Reference)
