City and Owner may be collectively referred to herein as the “Parties.” <br /> <br />RECITALS <br /> <br />A. The City is the owner of the real property located in the City of Pleasanton, generally <br />described as Santos Ranch Road, also known as “Parcel 1”, and more particularly described on <br />Exhibit A, attached and incorporated by this reference (the "Road"); and <br /> <br />B. The Road provides a means for the Owner to reach his or her residence; and <br /> <br />C. The Owner has requested permission from the City to use the Road for the purposes identified <br />in this Agreement, in return for the Owner's agreement to perform in accordance with the terms of <br />this Agreement. <br /> <br />NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND <br />CONDITIONS IDENTIFIED HEREIN, THE PARTIES HEREBY AGREE AS FOLLOWS: <br /> <br />1. PERMISSION FOR ENTRY AND USE. The City grants permission to the Owner (including <br />its invitees and agents) to enter all of Parcel 1 (the “Premises”), for the purpose of ingress to and <br />egress from the Owner’s residence located at _____________. <br /> <br />2. TERM. The term of this Agreement shall commence upon full execution of this Agreement by <br />the parties and shall terminate upon written agreement by the Parties. <br /> <br />Page 141 of 242
