parking needs. Although this would not guarantee parking for the applicant's customers, it
should help as long as the Bank continues its policy. Staff feels that the US Bank lot is ideally
located to provide convenient parking for the applicant's patrons and employees and would
reduce potential impacts on the surrounding residents. Since the Bank has not actually given
specific permission for the applicant's customers or employees to park in its lot, staff feels that
the applicant should also secure valet parking for her customers prior to opening the business.
In addition, since there is no guarantee of parking availability at all times at the Bank lot, staff
feels that the valet parking should be provided free of charge to ensure that customers will use
the service and not simply use the free on-street parking on Ray Street. A condition of approval
addresses these items.

Staffwould have preferred that the applicant had been able to secure specific permission for her
customers to park in an off-site parking lot after hours. However, with a condition requiring that
valet parking be provided at no cost to customers and the US Bank's policy not to tow vehicles
from its employee parking lot after bank hours, staffbelieves that there would be adequate
parking for the proposed use and that the potential parking-related impacts on the adjacent
residents and businesses would be minimized. Furthermore, a condition would require that the
applicant establish a valet parking plan prior to operation of the business or issuance of any
building permits for tenant improvements. Nevertheless, should parking-related problems
occur, staff has included a condition of approval which allows the Planning Director to refer the
use permit back to the Planning Commission for possible mitigation measures.

Altematively, should the Commission believe that adequate parking arrangements have not yet
been secured for the proposed use or want the applicant to finalize arrangements for the valet
parking prior to taking action on the application, then the Commission may continue the
application to allow the applicant additional time to make arrangements for additional off-street
parking for her customers and/or to prepare a valet parking proposal.

Noise

Patrons and low-level dining music would be the main noise sources emanating from inside of
the establishment. Given the applicant's proposed operation, staff does not believe that noise
from inside of the restaurant/bar would be audible to the adjacent residents or businesses. Staff
has included a condition of approval that requires the business doors to remain closed when not
being used for ingress/egress purposes and that the windows be closed during business hours.

The subject site is located directly adjacent to residences to the east. The restaurant/bar and its
parking lot are located several feet below these residences which should mitigate most low-level
parking lot noises (e.g., people conversing at a normal volume, opening and closing of car doors,
etc.). However, the residents could be disturbed if inconsiderate patrons were talking loudly in
the parking lot or outdoor dining areas, fighting, speeding, slamming car doors, honking horns,
"burning rubber," etc. Based on the applicant's desired business atmosphere, the patrons would

Page- 7
